The condominium association for the 341-unit, $1 billion Aston Martin Residences tower at 300 Biscayne Boulevard Way sued developer Riverwalk East Developments, architect Revuelta Architecture International, general contractor Coastal Construction South Florida, structural engineer DeSimone Consulting Engineering, and roughly a dozen subcontractors, alleging pervasive construction defects discovered in the roughly two years since the 66-story tower's 2024 completion. The complaint cites spalling concrete with exposed rebar, pool and spa leaks that have corroded reinforcing steel, cracked balcony slabs, seawall cracking, elevator defects, and leaking fire-suppression systems, and seeks a minimum of $750,000 in damages plus compulsory repairs the association estimates will run into the millions.

Why it matters

Filed less than two years after a marquee luxury tower reached 99% presale and delivered, the suit underscores that Florida's post-Surfside statutory reforms (mandatory milestone inspections, reserve funding) address ongoing maintenance but do nothing to shift the underlying construction-quality risk that still falls on developers and their design/build teams. Developers, GCs, and design professionals on large-scale coastal high-rise projects should expect condo boards to move faster and more aggressively post-turnover, and should confirm builder's-risk and completed-operations coverage — plus contractual risk allocation among the dozen-plus subcontractors named here — well before a project breaks ground.
