Feldman v. Pettit, Orton, and Mozart Properties (Private CRE Loan Default Suit Names Real Estate CEO)
Des Moines physician and private lender Dr. Bernard Feldman sued jailed Johnston, Iowa developer Daniel Pettit, real estate CEO Rob Orton, and their jointly held entity Mozart Properties on April 22 in Polk County, alleging breach of contract over an unpaid $850,000 loan made in 2021. The suit is the first in the sprawling Pettit fraud fallout to name Orton, chief executive of American Group LLC, a roughly twenty-company real estate holding group.
Why it matters
The case illustrates how private, relationship-based lending to local developers can leave lenders exposed once a borrower's distress spreads across dozens of affiliated entities, and how creditors increasingly pursue co-obligors and business partners once a primary borrower's own assets are exhausted or already subject to competing judgments. Private CRE lenders and investors should treat joint-and-several liability provisions and diligence on a borrower's other outstanding obligations as essential loan-structuring safeguards.
