Silver Fox 606 LLC v. Village of Indiantown: Data Center Developer Sues to Lock In Recorded Plat on 606-Acre Martin County Site
Silver Fox 606 LLC, which owns 606 acres zoned Heavy Industrial in Indiantown, Florida, filed a complaint and verified petition for a writ of prohibition in Martin County circuit court on October 7, 2026. The suit names the Village of Indiantown, its village council and its Planning, Zoning and Appeals Board. The developer says the village is improperly trying to undo a plat for its data center project that was administratively approved and recorded. It asks the court to bar the zoning board from hearing a citizen appeal of the plat. It also seeks declarations that the plat is final, and it raises a Sunshine Law claim against the council.
Why it matters
The case is an early test of Florida's 2025-2026 amendments to Section 177.071 of the Florida Statutes. Those amendments make plat approval a ministerial act decided by a designated administrative official instead of an elected body. The developer argues that a recorded plat cannot be vacated without the owner's consent. If the court agrees, developers of data centers and other contested by-right projects in Florida would have a strong defense against moratoriums imposed after a local election and against late appeals that work as automatic stop-work orders.
