On October 13, 2026, the Commonwealth Court of Pennsylvania affirmed a McKean County order enforcing a settlement between the City of Bradford and property owner DewBoi Properties, LLC over the city's taking of 374 square feet of an alley behind DewBoi's property for a new bus station. The owner had accepted $30,000 and the city's promise to relocate two utility poles, then balked when one pole was to be moved elsewhere on its lot, citing lost parking for its tenants and their customers. The court held the signed agreement unambiguously allowed relocation onto DewBoi's property and rejected the owner's mutual mistake defense.

Why it matters

Owners negotiating partial-taking settlements should pin down exactly where relocated utilities and other site features will go, because Pennsylvania courts will enforce the written agreement even when the practical effect on tenant parking only becomes clear later. Accepting payment and telling the court a deal is done makes it very hard to walk away.

In December 2023 the City of Bradford, Pennsylvania filed a declaration of taking to condemn 374 square feet of an alley running through the rear of a property owned by DewBoi Properties, LLC, as part of a project to build a new bus station. DewBoi filed preliminary objections, and the parties' lawyers negotiated a settlement over several months in 2024.
