CMBS Trustee Hits West Loop's 540 W. Madison With $310 Million Foreclosure Suit
A bondholder trustee sued to foreclose on 540 W. Madison, a 1.15M-square-foot, 81%-leased Chicago office tower, after its senior loan matured unpaid in September 2026.
A trustee representing bondholders on the senior mortgage loan secured by 540 W. Madison Street, a 1.15-million-square-foot, 81%-leased Chicago office tower, filed a $310 million foreclosure suit in Cook County Circuit Court against ownership entity 540 West Madison Owner LLC after the loan matured unpaid in September 2026. The building reportedly generates over $18 million in annual net cash flow against roughly $5.3 million in debt service, making this a maturity default rather than a cash-flow default.
Why it matters
The filing illustrates that occupancy and operating performance no longer reliably predict default risk in the current office-lending cycle: a well-leased, cash-flow-positive building can still face foreclosure if it cannot refinance a legacy loan sized to a valuation the market no longer supports. Owners approaching their own loan maturities should stress-test refinancing feasibility well before the maturity date, and lenders should expect more maturity-default foreclosures on operationally healthy office assets financed at prior-cycle valuations.
