$45.5 million mechanics'-lien foreclosure claim; a related suit over the same project produced a $74.6 million judgment against Monarch in February 2025
Parties
Plaintiff/Lien Claimant: PCL Construction Services, Inc.Defendant: Monarch Growth Inc.Defendant: Monarch Casino & Resort, Inc.Defendant: Monarch Black Hawk, Inc.

A Colorado judge lifted the stay in PCL Construction's $45.5 million mechanics'-lien foreclosure suit against Monarch Casino's Black Hawk expansion, reviving a dispute already tied to a $74.6 million judgment in a companion case.

Monarch Casino & Resort, Inc. disclosed in its October 30, 2026 10-Q that the judge in a long-stayed mechanics' lien foreclosure action in Gilpin County, Colorado lifted the stay effective September 16, 2026 and set a case management conference for January 22, 2027. The lien case, brought by former general contractor PCL Construction Services, Inc. over the completed expansion of the Monarch Casino Resort Spa in Black Hawk, carries PCL's own asserted lien of roughly $45.5 million.

Why it matters

The case shows that a mechanics' lien foreclosure against the real property itself can remain a live threat to an owner's title long after a money judgment has been entered in a parallel contract suit over the identical work -- here, a related 2019 Denver suit already produced a $74.6 million judgment against Monarch in February 2025. Owners and lenders financing hospitality and gaming expansions should track lien foreclosure actions separately from any companion damages litigation, since a stay in one case does not resolve exposure in the other.
