GWIP Land Company LLC v. Board of County Commissioners of Weld County: Neighboring Industrial Park Owner Seeks Reversal of GlobalAI Data Center Approval
Affiliates of Denver-based Broe Cos. that own the roughly 3,000-acre Great Western Industrial Park filed a 24-page complaint in Weld District Court (Case No. 2026CV31187) on October 6, 2026. They ask the court to review and reverse the Weld County commissioners' September approval of a use-by-special-review permit for GlobalAI Cloud Inc.'s data center on the 438-acre former Carestream Health property. The suit alleges improper commissioner intervention, rule changes tailored to the project, open-meetings violations and unenforced stop-work orders.
Why it matters
Most data center land-use suits pit residents against a project or a developer against a moratorium; this one is a commercial neighbor, the owner of a major industrial park, using the land-use review process to challenge a competing user's approval. The complaint's focus on power and water capacity, a code amendment written in anticipation of the project and a negotiated non-enforcement of stop-work orders gives a roadmap for how approvals of power-hungry facilities can be attacked. Industrial landowners, data center sponsors and their lenders should expect approvals obtained on accelerated or customized tracks to draw this kind of challenge.
