Metropolitan Milwaukee Association of Commerce v. City of Port Washington: Judge Dismisses Business and CRE Groups' Challenge to Voter-Approval Rule for Large TIF Districts
An Ozaukee County judge dismissed business and commercial real estate groups' challenge to Port Washington's voter-approved rule requiring a referendum for tax incremental districts over $10 million.
On October 19, 2026, Ozaukee County Circuit Judge Adam Gerol ruled from the bench and dismissed a suit by the Metropolitan Milwaukee Association of Commerce and a coalition of contractor, commercial real estate and Realtor groups against the City of Port Washington. The suit challenged a voter-approved ordinance that requires a referendum before the city creates any new tax incremental district with a project cost or projected base value above $10 million. The judge found the plaintiffs had shown no actual or imminent injury, that the dispute was not ripe, and that the ordinance is consistent with state law and not too vague to apply.
Why it matters
Port Washington's ordinance grew out of opposition to the city's $458 million tax incremental district for Vantage Data Centers' $15 billion campus, and it has been described as the first municipal ballot initiative in the country aimed at restraining future data center development. If it holds up, developers seeking large TIF packages in Port Washington will need to win a public vote, not just a council majority, adding schedule and political risk to big industrial and data center deals. Opponents of other projects may copy the approach, and the business groups have signaled an appeal.
