Non-monetary settlement; developer funds statewide environmental analysis

The Sierra Club settled its suit over permits for Vantage's $15 billion Port Washington data center campus; the permits stand and Vantage will fund a statewide data center impact study.

On October 16, 2026, the Sierra Club, the Wisconsin Department of Natural Resources and Vantage Data Centers settled the Sierra Club's suit challenging permits the DNR issued for Vantage's $15 billion Lighthouse data center campus in Port Washington without an environmental impact statement. The permits remain valid and no further environmental review of them is required. In exchange, the DNR will prepare a statewide strategic analysis of AI data center build-out and its effects by January 31, 2028, with Vantage paying the full cost.

Why it matters

The deal removes the main environmental litigation cloud over one of the largest data center projects in the Midwest without disturbing its permits, a template other developers facing environmental-review suits may try to follow. At the same time, a state-level cumulative-impact study of data centers, funded by a developer, could shape how the DNR reviews future campuses, power infrastructure and wetland impacts, and the Sierra Club says it still expects project-level impact statements where warranted.

Vantage Data Centers, based in Denver, is developing the Lighthouse campus in Port Washington, Wisconsin, a roughly $15 billion project for Oracle and OpenAI. As described in reporting on the case, the plan calls for four data centers on about 672 acres along Interstate 43, totaling some 2.5 million square feet. The first phase would draw about 1.3 gigawatts of power, with potential growth to 3.5 gigawatts, and the project would fill about 4.7 acres of wetlands.
