The Alabama Supreme Court reversed a Jackson County trial court that had declared a five-year, 135,847-square-foot Scottsboro industrial lease 'null and void in all respects' because the named landlord, Hembree Insurance Trust, had transferred title to the building to its own single-member LLC, Woods Cove Industrial Property, nine years before signing the lease. Hembree sued tenant Maples Industries in March 2024 for failing to repair the property's roof as the lease required; Maples countered that the lease was void because Hembree didn't actually own the building. The Court held that a tenant in possession generally cannot dispute its landlord's title, reversing summary judgment for Maples and remanding.
