New York's First Department affirmed a $307,326.18 judgment for Colliers against landlord City Hall Commons for a broker commission on a 2019 lease renewal.

On October 22, 2026, the Appellate Division, First Department unanimously affirmed a $307,326.18 money judgment for broker Colliers International NY LLC against landlord City Hall Commons LLC. The commission was for a September 2019 lease renewal with a nonparty tenant. The court held that the renewal agreement's statement that Colliers was the exclusive broker and that the landlord would pay its fee, together with emails showing Colliers' role in the negotiations, entitled the broker to its commission as a matter of law. The landlord's later refusal to sign a separate brokerage agreement did not change that.

Why it matters

In New York, broker-fee language in a lease or renewal can create a binding commission obligation on its own, even without a signed brokerage agreement. Landlords who name a broker and agree in the lease to pay its fee should expect to be held to that promise. Brokers should make sure renewal documents name them and assign the fee.

Colliers International NY LLC sued City Hall Commons LLC in Supreme Court, New York County, to collect a commission for a lease renewal between the landlord and a tenant that is not a party to the case. The decision does not identify the property. The September 2019 renewal agreement stated that Colliers was the exclusive broker for the transaction and that the landlord would pay the broker fees.
